By accessing or using the website (https://www.mobilehaircutmaitland.com), (the “Site”) or any services offered (“Services”), you (“you”, “User”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, do not access or use the Site or Services.
You affirm that you are at least 18 years of age. If under 18, you may only use the Services under parental or guardian supervision. By using the Site or Services, you represent and warrant that: (i) you are legally capable of entering binding contracts; (ii) you are not prohibited from using the Site or Services under any applicable law.
You may:
• Browse the Site for information about haircuts and bookings within Maitland and surrounding areas;
• Make appointments or inquiries through the available methods.
You shall not:
• Use the Site or Services for any illegal or unauthorized purpose;
• Post or transmit any false, misleading, harmful, obscene, abusive, harassing, defamatory, infringing or otherwise objectionable Content;
• Impersonate any person or misrepresent your affiliation;
• Interfere with Site operations or networks;
• Introduce viruses, malware, or other harmful code;
• Attempt to gain unauthorized access to systems or user accounts;
• Use automated means to access or use the Site or Services without permission;
• Violate any applicable law or regulation.
All content on the Site—texts, graphics, images, logos, designs, software, and other materials—is owned or licensed by Mobile Haircut Service Maitland or third parties and is protected by copyrights, trademarks, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works without express prior written permission.
You may submit feedback, communications, or other content (“User Content”) via the Site (e.g., appointment requests or messages). By submitting User Content, you grant Mobile Haircut Service Maitland a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, copy, modify, display, publish, transmit, and distribute your User Content for any purpose related to the Services. You represent that you own the rights to the User Content and your submission does not violate anyone’s rights.
THE SITE AND SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. MOBILE HAIRCUT SERVICE MAITLAND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILE HAIRCUT SERVICE MAITLAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Mobile Haircut Service Maitland and its affiliates, employees, agents, partners, officers, and directors from any claims, liabilities, losses, damages, expenses or demands (including reasonable legal fees) arising from your use of the Site or Services, violation of these Terms, or infringement of any rights.
Mobile Haircut Service Maitland reserves the right to suspend or terminate your access to the Site or Services at any time without notice for any conduct that breaches these Terms or for any reason. Upon termination, your right to use the Site or Services immediately ceases; all provisions that should survive termination shall continue to apply, including Sections 4, 6, 7, 8, and 11–15.
These Terms and any disputes arising from them or your use of the Site or Services shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to choice of law principles.
If a dispute arises, the parties must first attempt to resolve it informally by notifying the other party in writing. If unresolved within 30 days, the dispute may be submitted to mediation by a neutral mediator appointed by agreement, or by the Australian Centre for International Commercial Arbitration, before resorting to court proceedings.
Mobile Haircut Service Maitland reserves the right to modify or replace these Terms at its discretion. Changes become effective upon posting the revised Terms on the Site with a new “Effective Date.” Continued use of the Site or Services after the Effective Date constitutes acceptance of the updated Terms. We encourage you to review the Terms periodically.
If any provision of these Terms is held invalid or unenforceable under applicable law, such provision shall be struck to the extent of the invalidity, and the remaining provisions shall remain in full force and effect.
